The Australian Employer Nomination Scheme visa (sub 186) is for skilled workers who are looking to work in Australia. This two-step process begins with the employer nominating a potential employee to the Department of Home Affairs. Once an employer has nominated their chosen candidate, they will then be required to undergo a skills assessment that verifies that they have the qualifications and experience necessary for their position.

Once approved by the Department of Home Affairs, the candidate may apply for permanent residence through this visa subclass. The applicant must meet all criteria set out by Home Affairs before being granted permission to work in Australia on a long-term basis. To ensure compliance with immigration laws and regulations, employers must also provide evidence that they have followed proper recruitment procedures when selecting their candidates.

There are 3 main types of visa 186 streams you can apply for:

Direct entry stream

The Direct Entry Stream of the Employer Nomination (sub 186)     is an Australian immigration program that allows employers to sponsor employees from overseas directly. It is designed specifically for those who have never worked in Australia or have only briefly lived and worked there.

Those looking to enter the country under this stream must meet all of the necessary conditions set out by Home Affairs. These include having a valid job contract with their nominating employer, having at least two years’ work experience related to their nominated occupation, and relevant qualifications, if necessary. Furthermore, applicants must demonstrate that they can effectively carry out their nominated role during their stay in Australia and will maintain adequate levels of health insurance coverage while here.

Labour agreements stream

This visa stream allows Australian employers to hire skilled overseas workers and brings them onshore to work in their business. To apply for this program, your sponsor must be part of an employer-sponsored labour agreement with the Department of Home Affairs.

Labour agreements are legally binding commitments between the Australian Government and employers that allow employers to access temporary or permanent skilled overseas workers if they cannot find suitable local candidates.

Temporary residence transition stream

This stream would be ideal for you if you’re already or have previously held another temporary work visa subclass 457 or 482 and want to remain in Australia permanently.

Requirements

Employer Nomination (sub 186) is a permanent residency visa available to people who are nominated by an approved Australian employer. This type of visa enables individuals to live and work in Australia for an indefinite period as long as they meet the requirements.

In order to be eligible for Employer Nomination (sub 186), applicants must fulfill certain criteria. They must have been nominated by an approved Australian employer, be younger than 50 years of age or be exempt due to special skills shortages, and meet the skills, qualifications, and experience required by their sponsoring employer. Applicants also need to demonstrate that they have adequate English language proficiency and pass health and character checks.

Once all these requirements have been met, applicants can submit their applications along with documents proving they meet the above criteria.

Costs

Your 186 visa application fee is 4,045 Australian dollars. Additional fees may apply to you if you bring additional family members with you to Australia.
