The Student Guardian Visa (Sub 590) allows foreign citizens to remain in Australia as the guardian of a global student younger than 18 years old and studying in Australia on a student visa. This visa allows guardians to stay with their children for the duration of their academic program and provides them with greater peace of mind due to its protection and support.
By applying for this visa, guardians can help their children settle into Australian life by providing physical and emotional care while away. The purpose of this visa includes ensuring that students make adequate arrangements for accommodation, welfare, and general well-being while studying in Australia. Furthermore, the period of stay granted upon approval depends on how long the student’s course lasts; however, visas can be extended under certain circumstances if needed.
Requirements for Student Guardian Visa
- You must be either a parent or a guardian, and she has to be 21 years or older and have the nomination in writing by a parent or guardian.
- You are not permitted to bring children under six years of age under any circumstances.
- You’re expected to be able to provide hostel accommodations, medical care, and other welfare support for the individual if you’re applying for this visa with the help of the government from your country.
Pre-qualifying visas
If you are residing in Australia, you must have a current substantive temporary visa but not one of the following:
- Temporary Profession (International Relations) visa (subclass 403) in the Domestic Worker (Diplomatic or consular) stream
- Domestic Worker (Temporary) – Diplomatic or Consular visa (subclass 426)
- Transit visa (subclass 771)
- The primary visa holder of a Diplomatic (Temporary) visa (subclass 995) may apply for a Student visa in Australia.
- Visitor visa (subclass 600) in the Funded Family line or the Approved Destination Status area.
Any visa other than the Bridging Visa, the Criminal Justice System, or the Enforcement is substantively a short-term visa. It permits the visa holder to live and work temporarily in Australia.
Bringing children
Your children have to be at least six years old, or you can bring them only if both of the following apply:
- Compelling and compassionate reasons can be compelling.
- The granting of the visa greatly helps the relationship between the Australian government and other countries’ governments. If that’s the case, you must be at least 21, and a parent or figure with custody must support the student.
The child must obtain the same health requirements as you and be covered by medical insurance for their stay in Australia. Children 6 years old or older may accompany you, but they must apply for a student visa.
